"This is the worst thing that has ever happened to the environment in U.S. history. From everything we're hearing about now, it's become clear that BP cut corners to put profit ahead of safety. The message we are sending should tell all the oil companies to spend the money and take the necessary precautions to make sure this doesn't happen again," said Jonathon Davis of KORN. "I'm really proud that this many artists have already come on board, and I hope more will join soon."
First estimates show close to 100 vehicles, trucks and buses from the committed artists will be involved in the boycott this summer. The number is continuously growing, resulting in tours all across North America refusing to fill up with BP products. More touring artists and people throughout the continent are uniting in boycotts against BP as a result of the catastrophic oil spill.
Some summer festival tours like the Rockstar Energy Drink Mayhem Festival are already known for using biofuels. However, the entire festival, comprised of twelve bands, will promise to not purchase their biofuels from BP or any of their affiliates. Tour creator Kevin Lyman agrees, stating "We have so many friends that are now affected by this spill that unless BP spends whatever is needed their livelihoods are lost forever. To that end we are encouraging everyone we deal with to find alternative ways to get down the road this summer."

HOW IRONIC Pearl Jam Protested BP at Lollapalooza 2007 The Gulf of Mexico oil spill has lots of people angry at oil company BP. However, Pearl Jam were upset with them long before now. At the Lollapalooza festival in 2007, the band played a BP/Amoco protest song written by frontman Eddie Vedder, titled "Don't Go to BP/Amoco." Vedder wrote the song in protest of what he said was BP/Amoco's practice of dumping waste into Lake Michigan. Chicago, Lollapalooza's home, of course sits on Lake Michigan's shores. Lollapalooza 2010 happens August 6th through the 8th. The Rise and Fall of Kevin Rudd-and What It Implies for Obama and the Oil Spill
Barack Obama and Australia's Prime Minister Kevin Rudd both belong to a new class of leftist leaders: postmodern ones. This distinguishes them from either the Old Left or the New Left. The Old Left (led by men like Franklin Roosevelt) were class-warfare-focused but claimed to believe in economic progress: they said they wanted a modern world with the government in control of the means of production. The New Left (the hippies and their contemporary descendants, the Greens) witnessed the failure of that socialist/fascist ideal in every country it was tried and, in bitterness, threw economic progress overboard to adopt a policy of living at the mercy of nature.
Unsurprisingly, the New Left failed to attract wide support. Its contempt for human survival was too apparent. Thus the postmodern left was born. The postmodern left combines a thirst for an ever-growing centralized government power with cunning levels of disguise to appear to be all things to all men. Hostility to science is wrapped in the language of science (global warming theory). The shackling of capitalism is dressed up as saving it (the stimulus packages). Hostility to US predominance is dressed up as a desire for a new world order in which US strength is "restraint." In fact, under all its disguises, the postmodern left believes in nothing but power for itself and the weakening of the institutions of the West. The common denominator of its policies: ObamaCare, cap-and-trade, the takeover and regulation of big business, internationalism, isolation of Israel, fawning over enemies and taking tough lines against their allies, is: Western disempowerment.
This is why Barack Obama and Kevin Rudd are both dynamite on their respective nations but greatly strengthen foreign enemies.
The protection for their agenda has been its sheer unbelievability. Few Western citizens thought postmodern leaders intended to persist in their destructiveness once the drawbacks of their programs were pointed out. How many thought Obama would continue with his health care program against overwhelming public resistance and in the face of the loss of Ted Kennedy's old Senate seat-an effective referendum on his policy? But he did. In Australia, Prime Minister Rudd was no sooner crushingly defeated on one means of shackling the Australian economy (cap-and-trade) than he singled out the most efficient industry in Australia-mining-to hit with a brand new 40% tax on Super Profits-a "Super Profit" being defined as any profit above a 6% return. (It is no accident that the term "Super Profit" was coined by Lenin.)
But the power of Obama and Rudd has peaked and is now in sharp decline. Both have gone from approval ratings around the 70% mark to the 40s. It is worth understanding why.
In the first place their irrationality and economic wastefulness has galvanized the pro-freedom side of politics. In America it is the Tea Party movement. In Australia it is the supporters of capitalism and the best of the media (Andrew Bolt and The Australian newspaper) who are leading an increasingly successful resistance. While seeing clearly the flaws in the right-leaning opposition party (the Liberal-National parties in coalition) they are relentless in exposing the Rudd government's lies, deceptions, and failings. Yet ironically it will probably not be the people who saw through Obama and Rudd right from the start who bring them down. What may be the undoing of both leaders is the disillusionment of those who believed in them most, in the area of their biggest lies: the environment. As Rob Tracinski has pointed out, a US president has no business micro-managing the cleanup or even the prevention of an oil spill. Yet Obama, like Rudd over his Emissions Trading Scheme, has raised his supporters' expectations. Obama is the man who claimed he could, just by his nomination, cause the oceans to lower. Now he can't even prevent them from carrying the spill of a single oil rig.
The bubble is bursting for him not because he has disappointed real expectations but because he dealt in unreality all along, and his followers are betrayed because the unreal is the unreal and never had any value.
So it is with Kevin Rudd. He claimed to believe more than anyone in human-caused global warming. He called it the "great moral challenge of our age." Yet he has abandoned it because he hasn't had the guts to carry out his threat of dissolving both houses of parliament to pass bitterly opposed legislation-knowing he would fail. Now it is his most ardent supporters who are abandoning him. Take the leading climate alarmist Tim Flannery who will be a model for many an Obama supporter. As the Australian News website reported:

Tim Flannery, a former Australian of the Year, said he was unlikely to vote Labor again after Mr Rudd shelved plans for an emissions trading scheme.
"It's a profound betrayal of the person I voted for,'' Professor Flannery said at a conference in Canberra.
"Politicians only have one thing that they trade in, which is trust ... unfortunately my trust in the party's been corroded."
Rudd, like Obama, depended on a mystique. He was the leader who could do anything. Now his loss of confidence is causing all of his actions to have a touch of panic and he is floundering without support. The opposition to his big mining tax is growing daily.
Obama has gone one step further. He has promised a world where the government can control everything. Like Rudd since the failure of cap-and-trade, he will not even be able to control his own followers when the truth of his impotence over the Gulf oil spill stands fully revealed

Climate change legislation appears dead after two setbacks in quick succession — first from the Oval Office and then from Congress.
Sen. Scott Brown (Mass.), a crucial Republican swing vote, met with President Barack Obama on Wednesday and told him he would not support a cap-and-trade plan or carbon fee to limit greenhouse gas emissions.
But this blow came after Obama delivered the first setback Tuesday night. In his primetimes speech, he called for comprehensive energy reform but did not propose an emissions cap.
This stance may parallel his rhetorical backing for a public healthcare option that, however, was later excluded from reform legislation.
The White House has told Sen. John Kerry (D-Mass.) and environmental activists that it supports the carbon cap in his bill, but the presidential bully pulpit has not been used to demand it.

The global warming movement is in heavy retreat in every Western country. But, as we have learned from the rise of leftist leaders like President Obama and Australia's Prime Minister Kevin Rudd, modern collectivists are resilient. If they can recover from the collapse of Communism, they can certainly rebuild the environmental movement. Now is not the time to celebrate, but to press home the exposure of their bogus claims and hidden interests.
TIA Daily readers will therefore appreciate the uncompromising interview style of Australian journalist Andrew Bolt as he eviscerates one of the world's leading warming alarmists, Tim Flannery-a man in the mold of Al Gore. The interview took place on radio in Melbourne, Australia on June 9.

The debate begins with Bolt asking Flannery about his disillusionment with the Australian government over its ditching of Cap and Trade:
Flannery: I'm unlikely to vote for him [Rudd] because my trust has been eroded away.. He promised to deliver an emissions trading scheme and he's then withdrawn that with very little justification..
Bolt: He said he wouldn't move now until the rest of the world did something which is a direct repudiation of what he said before. But, Tim, part of the reason, of course, that he's backed down is that there's been a great swing in sentiment against this kind of thing, there's a rising tide of skepticism. How much are you to blame for some of that?
Flannery : There is some swing in sentiment. And I think it's very hard to maintain any issue with that sort of very high level of support for a long time. So there's some, but what is happening around the world should give us all heart. We've seen China now pledged to reduce is emissions intensity by over 40 per cent.
Bolt: It's still going to build a coal-fired power station every week or so.
Flannery: And what that is going to do if that's achieved by 2020 is put us on track to avoid dangerous climate change. But for us to do that, places like Australia and the US, the wooden spooners in this debate, actually have to do their part.
Bolt: But, Tim, I'm just wondering, there has been a rise in skepticism. That's precisely why the Liberals [the Australian Liberal party is closer to the classical pro-free market 19th-century meaning of that term rather than its modern sense], for example, have switched from supporting an ETS to opposing it...and they dumped their leader over it. Now I'm wondering to what extent are you to blame for rising skepticism about some of the more alarming claims about global warming.
Flannery : Well, many of the things that scientists highlight may happen are very alarming. They're not alarmist but they are worrisome. Rises in sea-levels, for instance, are a significant issue.
Bolt: Well, let's go through some of your own claims. You said, for example, that Adelaide may run out of water by early 2009. Their reservoirs are half full now. You said Brisbane would probably run out of water by 2009. They are now 97 per cent full. And Sydney could be dry as early as 2007. Their reservoirs are also more than half full. How can you get away with all these claims?
Flannery: And thankfully, Andrew, governments have taken that to heart and been building some desalination capacity such as in Perth.

Flannery: What I have said is that there is a water problem. They may run out of water. And .

Flannery: That's a lie, Andrew. I didn't say it would run out of water. I don't have a crystal ball in front of me. I said Brisbane has a water problem.
Bolt: I'll quote your own words: "Water supplies are so low they need desalinated water urgently, possibly in as little as 18 months." That was, on the timeline you gave, by the beginning of 2009. Their reservoirs are now 97 per cent full.
Flannery: Yeah, sure. There's variability in rainfall. They still need a desal plant.
Bolt: You also warned that Perth would be the 21 century's first ghost metropolis.
Flannery: I said it was.may.
Bolt: It's all "may." Right?
Flannery: Because at that stage there had been no flows into that water catchment for a year and the water engineers were terrified.
Bolt: Have you seen the water catchment levels here, see, they're tracking above the five year level. I'm showing you now.
Flannery: You know what I came in here to talk about, Andrew, here? It's our farm day we're doing with our Deakin lecture series in Bendigo, at the Bendigo town hall today. And it's a really exciting event.
Andrew: All that's lovely, Tim. But I think you need to be held to account for the alarmism that is in part your stock in trade, your shtick, and is responsible for what you now see-the retreat from global warming policies.
Flannery: You want to paint me as an alarmist.
Bolt: You are an alarmist.
Flannery: I'm a very practical person.
Bolt: I'm asking you to defend these quotes.
Flannery: Well, I've done that already
Bolt: You said the Arctic could be ice free two years ago. [Actually, last year.]
Flannery: No I didn't.
[The show host, Steve Price interrupts, and they argue over the questioning.]
Bolt: I'm asking Tim whether he repents from all these allegations about cities running out of water, cities turning into ghost cities, sea level rises up to an eight-story-high building. Don't you think that is in part why people have got more skeptical?
Flannery: I don't, actually, because some of those things are possibilities in the future if we continue polluting as we do. And we've already seen impacts in southern Australia on all of those cities. Everyone remembers the water restrictions and so forth. Just because we get a good, wet year doesn't mean we should forget about the problem. We actually have to deal with this long term drying trend and that means securing our water supply.
Bolt: You warn about sea level rises up to an eight-story building. How soon will that happen?
Flannery: Asking that question is it's a bit like asking a stock analyst when the next stock market crash is going to happen and how big it's going to be. No one can. We can all see the underlying weakness in the market in the months before the crash.
Bolt: Thousands of years?
Flannery: Could be thousands of years.
Bolt: Tens of thousands of years?
Flannery: Could be hundreds of years.
Bolt: Hundreds of years?
Flannery: It could be hundreds of years. The thermo- dynamics of ice sheets are very, very difficult to predict, but what we do know when we look back is the fossil record is that when the world is a degree or two warmer than it is now seal levels rise very significantly-between four and 14 meters above where they are. We can't say how long it takes for that rise to happen because the fossil record just isn't good enough, it isn't accurate enough.
Bolt: Should we also have nuclear power plants?
Flannery: In Australia I don't think so. We've got such a great load of assets in the renewable area that I don't think there's an argument here that they are ever going to be economic.
Bolt: Four years ago you did. What changed your mind?
Flannery: No, I never did. I've always had the same argument.
Bolt: No, no, no. Here's your quote: "Over the next two decades Australians could use nuclear power to replace all our coal-fired power plants. We would then have a power infrastructure like France and in doing so we would have done something great for the world." That was your quote.
Flannery: I don't recall saying that at all.
Bolt: You wrote it. You wrote it in The Age. There it is, highlighted.
Flannery: Well ,very good.
Bolt: That's the point, you know, you make these claims and when people confront you, you walk away from them.
Flannery: But that was about "may." No, no, you said "may." And Australia may be able to do that. It's not what I recommend and I never have recommended it. But what I do say.
Bolt: "We would have done something great for the world."
Flannery: But what I do say, nuclear power, right, getting away from coal would be great for the world. Why should we take the most expensive option in this country, which has always been recognized as having the most expensive and difficult option. We are going to see a whole lot of other technologies and innovations which are now well under way which we could use instead of nuclear power.
Bolt: Such as?
Flannery: Such as concentrated PV technology, geothermal technology, wave power, wind power.

Commentary: Section 3663A of Title 18, U.S. Code, mandates that those convicted of certain crimes pay restitution to the victims of those crimes. This bill would add a wide range of conduct prohibited by the Federal Water Pollution Control Act, commonly known as the Clean Water Act, to the list of crimes for which restitution must be ordered as part of the sentence. Because restitution would be mandatory, federal courts would not have the discretionary authority to decide in any case that restitution is not warranted. Under 33 U.S.C 3319(c), any person who "negligently" or "knowingly" violates a number of provisions of the Clean Water Act can be prosecuted. In addition, any person who "knowingly" violates any of those provisions and "who knows at the time that he thereby places another person in imminent danger of death or serious bodily injury" is subject to increased punishment.
S. 3468: Stop the Sale of Murderabilia to Protect the Dignity of Crime Victims Act of 2010

Commentary: Subject to specified limitations, this bill would prohibit inmates convicted of violent crimes and incarcerated in federal and state prisons from "knowingly" mailing "any property, article, or object, with intent that the property, article, or object be placed in interstate or foreign commerce." The exceptions would permit the mailing of title documents, mailings meant to satisfy any debt imposed by law or a court order, and mailings resulting from a contract for specified subjects. An inmate convicted of violating this act would be subject to imprisonment for not less than 6 months and up to 10 years, with the term to run consecutively to any other term of imprisonment, and a fine as authorized by Title 18, U.S. Code.

Commentary: This bill is a response to the oil spill in the Gulf of Mexico. It would increase the fine for those who "knowingly and willfully" violate the provisions of 43 U.S.C. § 1350(c). "Any person" who "knowingly and willfully" violates a subsection of § 1350(c) is subject to imprisonment for 10 years, a fine, or both, and the bill would increase the amount of the fine from $100,000 to $10 million. Section 1350(d) of Title 43 currently provides that, where a corporation or other entity is subject to prosecution, "any officer or agent of the same corporation or entity who knowingly and willfully authorized, ordered, or carried out the proscribed activity" can be individually prosecuted.
S. 3302: Motor Vehicle Safety Act of 2010

Commentary: This bill is a response to allegations regarding sudden acceleration by Toyota automobiles and related allegations regarding Toyota's response to those claims. It includes provisions calling for the Secretary of Transportation to promulgate new safety standards. Sections 30118, 30119, and 30116 of Title 49, U.S. Code, already include provisions that require automobile manufacturers to notify the Secretary of Transportation and owners, purchasers, and dealers of vehicles of any safety defects with those vehicles, specify the form of notices and the procedures for supplying them, and call for the maintenance of certain records. The bill would increase the penalty for violating 18 U.S.C. § 1001 by providing an additional penalty for submitting a false report required by 49 U.S.C. §§ 30118, 30119, and 30166 "with the specific intent of misleading the Secretary with respect to motor vehicle or motor vehicle equipment safety related defects." The new penalty would provide for up to 12 months of imprisonment in addition to the current penalty of imprisonment for up to 5 years, a fine as authorized in Title 18, U.S. Code, or both.
